    NORTH PERRY, Ohio - The Perry Nuclear Generating Station near Cleveland is under intense scrutiny by Nuclear Regulatory Commission inspectors, who have uncovered a pattern of safety violations inside the plant.

    The plant, located 35 miles east of Cleveland in the small community of North Perry, opened in 1987 and produces enough electricity to power one million homes.

    But lately, Perry has been generating headlines.

    Chuck Casto is a Nuclear Regulatory Commission Regional Administrator who is overseeing ongoing inspections at the plant following a series of safety violations involving workers inside the plant.

    "It starts to worry you about the spread," Casto said. "Are problems spreading?"

    Our exclusive 5 On Your Side investigation obtained NRC inspections reports, letters from regulators to FirstEnergy, which owns the plant, and gained rare access to the NRC's "Incident Response Center" that monitors nuclear plants around the clock from a control center in Chicago, 300 miles away.

    We found that safety problems at Perry in 2011 triggered an NRC response that dropped the plant two full safety levels to what it refers to as a "Column Three" plant, a "degraded" category that's shared with only two of 104 nuclear plants in the entire country.

    "They were in 'Column Three' because they had several issues in the worker protection area," Casto said. "Also they had one issue in security, which, obviously, I am not going to talk about."

    Casto said the security issues was resolved, but Perry violated federal safety regulations when workers, in April 2011, removed an instrument from deep inside the reactors core.

    "They misunderstood the conditions," Casto said. "That instrument was highly radioactive." Casto called it a "near miss" of "significantly overexposing some workers."

    But our exclusive 5 On Your Side investigation reveals that problems continue at the plant.

    Last March, NRC inspectors found "performance at the plant continued to exhibit weaknesses." And in June, low level radioactive wastewater spilled onto the floor.

    Jennifer Young is a FirstEnergy spokeswoman who said a pipe broke while moving from a storage tank to a shipping container.

    But documents obtained by NewsChannel 5 indicate the company waited six months before it ultimately found that an "emergency condition" should have been declared under NRC regulations.

    "After some discussion with the NRC and after some discussion internally, we said we probably should look at right by where the spill was--how much did it go up," Young said.

    It turns out that FirstEnergy failed to properly calculate radiation levels until a review of the incident last November, resulting in what the company calls "equivalent to a catscan." Even so, an NRC report into the spill called the incident a "performance deficiency."

    Meanwhile, a former employee at the plant claims he was fired for alerting NRC inspectors to potential safety violations.

    "It shows that people are violating basic safety procedures and if they don't care about their own safety, how can they care about your's or the community's?" Bryan Reo said.

    FirstEnergy denied Reo's allegations and said "all those were investigated at the time they were raised and none of those cases did we substantiate a safety concern."

    The NRC's ongoing probe of safety at Perry is also being followed by the Union of Concerned Scientists, an advocacy group that follows energy issues.

    David Lochbaum is a nuclear engineer and the organization's nuclear safety director, as well as a former NRC instructor.

    "So far, the radiation breakdowns haven't resulted in excessive exposure to workers," Lochbaum said. "But in many cases, that was more luck than skill."

    FirstEnergy said it is working hard to correct deficiencies at the plant and improve workers safety. Even so, the NRC has given the company a strong warning.

    "We need to see behavior changes in terms of worker behavior with radiation," Casto said. "Those changes need to be procedure changes and the need to be sustainable."

    If not, Lochbaum said he believes the NRC is "running out of patience" with FirstEnergy and the future of the plant could be in jeopardy.

    "If progress isn't made in short order, six months, the next, more onerous step could be taken by the NRC which could include shutting the plant down until these fixes are made."

    The NRC expects to complete its series of investigations in the plant safety by this spring.

      NORTH PERRY, Ohio (WOIO) - Authorities arrested a 33-year-old man Wednesday evening after he drove onto Perry Nuclear Power Plant property and said he had a bomb, according to police.

      Michael D. Fogelsong, of Adrian, Michigan, showed up at Perry Nuclear Power Plant around 6 p.m. Wednesday and refused to leave, police said.

      When plant security confronted Fogelsong, he claimed to have a bomb in the trailer attached to his pickup truck, police said.

      The Painesville FBI, Lake County Sheriff’s Office, North Perry and Perry Village police departments, and the Lake County Bomb Squad responded to the property to investigate the claim, according to police.

      Authorities did not find a bomb, police said. “We want to ensure everyone that there is no ongoing threat or imminent threat to the Perry Nuclear Power Plant,” Lake County Sheriff’s Office said in a press release.

      Fogelsong is in Lake County Jail, according to police. He is facing charges of making false alarms and aggravated trespass. Additional charges may be filed, police said.

      Jason Copsey of Falls Communications released this statement about the incident:

      At approximately 6 PM Wednesday evening, two individuals mistakenly drove onto the property of the Perry Nuclear Power Plant. Plant security notified local authorities. It was determined the individuals posed no credible threat to the plant or public safety.

      Authorities cleared the scene at Perry Nuclear Power Plant around 11 p.m. Wednesday.

      Lake County Sheriff’s Office continues investigating this incident.

      Perry Nuclear Power Plant is located at 10 Center Road in North Perry Village.

        Michael Fogelsong was arraigned by former Judge Michael Cicconetti, who presided over court on Friday morning in place of the normal Painesville Municipal Court judge while absent on vacation.

        The retired judge, like he has in many of his past cases, made Fogelsong’s initial appearance memorable.

        Fogelsong begged with Cicconetti for his release, claiming he is suffering from mental health issues.

        “You put this entire county in a panic, and I’m not going to let you out because you say you have a mental health issue,” the judge said.

        The suspect also said he is not even sure how he ended up in Lake County at the Perry Nuclear Power Plant.

        “I’m sick and damn tired of people coming in here, them saying they have mental health issues, then we release them out. And what happens? They end up shooting people,” the judge added.

        Investigators said Fogelsong drove a pick-up truck, which was pulling an enclosed trailer, to the power plant on Wednesday evening.

        When confronted by security, the Lake County sheriff said Fogelsong told officials he had a bomb in the trailer and refused to leave.

        Lake County Sheriff deputies, the Lake County Bomb Squad and agents with the Painesville Branch of the FBI responded to the plant and checked the trailer, eventually determining that it did not contain any dangerous material.

        Fogelsong is charged with making false alarms and aggravated trespass. Judge Cicconetti, who set bond at $100,000, said he expects federal charges to be presented against Fogelsong.

        A mental health evaluation was ordered immediately for Fogelsong. If released, he must also be fitted for GPS monitoring and turn in his driving privileges.

          A Michigan man accused of claiming he had a bomb at the site of the Perry Nuclear Power Plant was arraigned on another charge April 14 in Painesville Municipal Court.

          Michael D. Fogelsong, 33, of Adrian, Mich. was arraigned on a fifth-degree felony methamphetamine possession charge, according to court records.

          So far Fogelsong has been arraigned on two charges. On April 9, he was arraigned on a misdemeanor criminal trespassing charge.

          According to the Lake County Sheriff’s Office, at 5:43 p.m., April 7, the North Perry Police Department, assisted by the Perry Village Police Department, was dispatched to the plant at 10 Center Road in North Perry Village regarding a suspicious male refusing to leave the property.

          Upon arrival it was found that the male had driven a pickup truck pulling an enclosed trailer to the entrance of the facility and claimed to have a bomb in the trailer, according to a Sheriff’s Office news release.

          The Lake County Bomb Squad and the Painesville Branch of the FBI were requested to respond. The Sheriff’s Office Detective Bureau was then requested to assist the FBI on the investigation.

          The truck and trailer were subsequently found not to contain any dangerous ordnance after a detailed inspection, the release stated. Fogelsong was booked into the Lake County Jail.

          At the April 9 hearing, assigned judge Michael Cicconetti set Fogelsong’s bond at $100,000 with a 10 percent option.

          Cicconetti said during the hearing that although the charge currently against Fogelsong is only a fourth-degree misdemeanor, he was setting a bond that would keep him in jail “until I have further information.”

          “I don’t care if it’s a misdemeanor of the fourth degree, as far as I’m concerned you put this whole damn county and everybody in a panic,” Cicconetti said.

          Cicconetti ordered an immediate mental health evaluation for Fogelsong. Court records indicate Fogelsong’s mental health evaluation was received by the Painesville Municipal Court on April 13.

          Fogelsong is scheduled for a pretrial hearing April 20, according to court records. He remains in jail in lieu of bond. If Fogelsong does post bond, he will be placed on GPS monitoring and will be prohibited from driving motor vehicles. He is also prohibited from possessing weapons or firearms as well as further acts of violence.

          A U.S. Attorney’s Office for the Northern District of Ohio spokesperson told the News-Herald April 12 he could not comment on whether federal charges will be filed against Fogelsong. An FBI spokesperson said the Lake Cou

            Michael Fogelsong waived his preliminary hearing with Painesville Municipal Courts, meaning the case will be reviewed by a Lake County Court of Common Pleas grand jury.

            The suspect’s attorney asked for a bond lower than the $100,000 bail that was set due to his cancer diagnosis and medical appointments, but the judge said Fogelsong remains a flight risk and must remain monitored.

            The judge also suggested on Tuesday that Fogelsong, who was ordered to undergo an immediate mental health evaluation following his initial court appearance, may have to go through another exam.
