    A Sarcoxie School Board member and former associate professor at Missouri Southern State University was in federal custody Friday on a charge of possession of child pornography.

    The investigation started when Sarcoxie school officials reported that some students said he had exposed himself while they were working at his farm.

    John R. Lewis, 67, 4360 Dandelion Road, Sarcoxie, was arrested Thursday night shortly before a school board meeting on a federal complaint alleging that child pornography was found Dec. 5 on computers he owned.

    An affidavit filed with the U.S. District Court in Springfield by Charles Root, a Joplin police officer working with the Southwest Missouri Cyber Crimes Task Force, states that child pornography was found on computers and laptop computers taken from the home of Lewis on Oct. 4, 2012. Investigators went to his home that day to talk to him about allegations that Lewis had exposed himself to a Sarcoxie High School student, according to the affidavit.

    According to the officer’s sworn statement, the Jasper County prosecutor’s office was contacted after a school district official overhead a conversation among some male students. “The school official later talked to one of the students, who confirmed he was present at Lewis’ residence when Lewis exposed his penis in close proximity to another student’s face,” the affidavit states.

    Investigators then interviewed two students who said that the exposure incident happened in the late spring of 2012 when students were working for Lewis on his farm.

    “Both students disclosed that after swimming in the creek with Lewis, he stood up in an all terrain vehicle in which one of the students was seated next to him, when he pulled down his underwear exposing his penis just a few feet from the face of the student seated in the front seat of the all terrain vehicle,” the affidavit states. “The students disclosed conversations Lewis had with them about masturbating and how he would touch them on the buttocks when they were working.”

    During an interview with officers Dec. 5 at his home, Lewis denied exposing himself to any to any Sarcoxie High School student who worked at his farm, according to the sworn statement.

    After the interview, the officers asked to search his computers for child pornography. Lewis said he had a desktop and a laptop, and pointed out the desktop computer in an office. “Lewis stated he had downloaded images of naked children from a nudist website to his desktop computer” and refused to consent to a search, the affidavit states.

    Based on the disclosure, the officers obtained a search warrant. The officers found another computer in a basement bedroom along with some electronic storage devices, the officer stated. They were submitted to the Cyber Crimes Task Force for analysis. Investigators found 19 multimedia files and 113 images of suspected child pornography.

    “The multimedia files and still images primarily depicted male children, with the youngest child being approximately 5 years of age” engaged in sex acts, the affidavit reads.

    Lewis is serving his first term on the Sarcoxie School Board and has filed for re-election.

    Kevin Goddard, school superintendent, contacted Friday, said, “Because of the ongoing investigation, there’s very little I can say.”

    In a written statement, he said: “Nothing is more important to the district than providing a safe and secure learning and working environment for children. The district is aware that law enforcement authorities are investigating allegations against a school board member. The district is providing its full cooperation in connection with the investigation, and will continue to do so. However, the district cannot give specific information about the investigation due to state and federal confidentiality laws.”

    Lewis has done volunteer work with the city of Sarcoxie.

    Mayor Don Triplett, asked if Lewis served in any city capacity involving children, said, “Not to my knowledge. He is active in a number of different things. He was on the TIF (tax increment financing) Commission. He is active in the local Chamber of Commerce and different groups,” Triplett said. He said no conclusions should be drawn based on an allegations. “Let’s let the courts do their job,” Triplett said.

    Among his civic activities, Lewis also is a Jasper County Republican committeeman and a member of the 7th Congressional District Republican Committee.

    As a school board member, he spoke against former Sheriff Archie Dunn distributing T-shirts to schoolchildren last fall that promoted the Drug Awareness Resistance Education (DARE) program but also had advertising on it for Dunn’s re-election campaign.

    A spokeswoman for MSSU said Friday that records show Lewis was employed as an associate professor from 1999 to 2008.

    Detention hearing

    A detention hearing is set for Wednesday in federal court in Springfield. A judge will determine if Lewis is eligible for bond and, if so, how much.

    ewis ultimately filed a complaint with the Missouri Ethic Commission about the DARE t-shirts mentioned in this article. The Ethics Commission ruled that the complaint was unsubstantiated. He also filed a 2nd complaint with the Commission alleging an advertisment, paid for by an individual, published in the Globe should have been classified as a political advertisement for Sheriff Archie Dunn's re-election. That allegation was also ruled to be unsubstantiated by the Etics Commission. This 2nd complaint filed by Lewis is the same one that Kaiser asked a former Jasper County official to file with the Ethics Commission. Kaiser's stated intent to this individual was to have the complaint appear to come from within Dunn's supporters. This former County official refused so apparently Kaiser asked Lewis to file the complaint.

    I notice that White men instinctively assume that other White men are innocent of alleged sex crimes which are created by the police and that White females and non-whites instinctively assume that White men are guilty of whatever sex crime is alleged. The reason is that this is the easiest way to destroy White men and White families is to make that accusation. Any one of us is living under that threat. In fact, that exact same thing happened to me and it took me hanging tough while imprisoned, doped up and tortured in a NutHouse until I could get out on an affordable bond and be my own attorney and have the case fall apart because my grandson refused to lie against me at a preliminary hearing.

    The government does this sort of thing all the time. What matters isn't innocence or guilt, but who is in power to make the accusation and furnish the 'proof.'

    So the best thing to do is to make life unsafe for everyone who isn't a White male by simply letting White males make accusations against the government, White females, and non-whites and thus assume that they are guilty simply by making the accusation. Let's no longer pretend that we are living under Rule of Law but rather do anything and everything we want to in seeking power to destroy our enemies.

      SPRINGFIELD, Mo. – A Sarcoxie school board member was charged on Friday with possession of child pornography in the federal district court in Springfield.

      John Lewis, 67, Sarcoxie, was charged in a criminal complaint filed in the U.S. District Court in Springfield with possessing child pornography and accused in an affidavit with the charge of exposing himself.

      Tammy Dickinson, United States Attorney for the Western District of Missouri, said Lewis was arrested without incident prior to Thursday night’s school board meeting and remains in federal custody pending a detention hearing.

      According to an affidavit filed in support of Friday’s federal criminal complaint, Missouri State Highway Patrol troopers contacted Lewis as part of their investigation into allegations that he had exposed himself to a group of high school students who were working for Lewis on his farm outside of Sarcoxie.

      Sarcoxie Superintendent Kevin Goddard said Lewis is still a member of the Sarcoxie Board of Education as of late Friday.

      Don Ledford, spokesman for the U.S. Attorney’s office in Kansas City, said Lewis was still in custody as of late Friday.

      Ledford said Lewis was arrested as he got out of his car to attend a school board meeting on Thursday night.

      Ledford said prosecutors filed a motion asking that Lewis be held without bond. A hearing on that motion will likely be held next week.

        Federal court records indicate that Daniel Whitworth of the Whitworth and McPherson firm of Joplin has signed on as attorney for Sarcoxie School Board member John Lewis, 67, who is charged with sexual exploitation of minors.

        Lewis' arraignment is scheduled for 9:30 a.m. Wednesday, in U. S. District Court in Springfield. An affidavit filed Friday accuses Lewis of possessing child pornography and exposing himself to high school boys. The affidavit information can be found at this link.

        Lewis is also a member of the Jasper County Republican Central Committee.

          A federal judge’s order denying bail for Sarcoxie School Board member John Lewis makes mention of evidence that Lewis was in alleged possession of nude photographs of local youths.

          U.S. Magistrate Judge David Rush entered an order Tuesday in federal court in Springfield that Lewis continue being held without bail.

          The 67-year-old former associate professor at Missouri Southern State University has been in federal custody since his arrest Feb. 21 following a long investigation by the Missouri State Highway Patrol and the Southwest Missouri Cyber Crimes Task Force. He is being held at the Christian County Jail in Ozark.

          An initial complaint and supporting affidavit filed in federal court alleged that child pornography was found on computers taken from Lewis’ home by investigators in October. A federal grand jury indicted him Feb. 28 on one count of receiving child pornography and a second count of possessing such material.

          In denying the defendant bail, the judge noted a potential danger Lewis poses to the community inherent in allegations that he exposed himself to two 16-year-old boys who worked on his farm and that he possessed photographs of “unclothed young men from the area, who may not have been above the age of consent at the time the photos were taken.”

          The judge further noted a flight risk the defendant poses since he “is a seasoned world traveler, who has visited approximately 30 foreign countries.” Although Lewis currently holds a passport, he told an officer of the court that it had been stolen and then told the judge that it had been misplaced, the judge’s order notes.

          “More tellingly, the defendant recently applied for a new passport,” the judge wrote.

          The judge also cited the “substantial financial resources” of Lewis, with an estate worth about $2.2 million, a lack of family ties to the area since he was an only child and his parents are deceased, and the fact that he is retired and not currently employed.

          The affidavit filed in support of the initial complaint had contained the uncharged allegation that Lewis exposed himself to two Sarcoxie High School students. The students told investigators the incident took place in late spring of last year while they were working for him on his farm.

          The students disclosed that after swimming with them in a creek, Lewis stood up in an all-terrain vehicle and pulled down his underwear, exposing himself near a student seated in front of him. They told investigators that he had talked with them about masturbation and would touch them on their buttocks as they were working.

          The affidavit stated that Lewis told investigators that he had downloaded images of children from a nudist website to a desktop computer. But the document made no mention of nude photos of “young men from the area.”


          Phrasing

          The judge’s phrasing of the order suggests that the ages of the subjects of the photos may be an investigative matter.

            Sarcoxie Board of Education member John Lewis pleaded not guilty this morning in federal court in Springfield to child pornography charges.

            During the 19-minute session, Lewis waived the formal reading of the grand jury indictment against him and had a motion for the judge to reconsider bond denied, meaning Lewis will remain behind bars until his trial.

            The grand jury indicted Lewis Feb. 28 for receiving pornography between Jan. 3, 2007, and Dec. 5, 2012, "in Jasper County and elsewhere." The second count says that on Dec. 5, 2012, Lewis possessed the pornographic material.

            The government asked that Lewis be held without bond since "this matter involves the commission of a crime involving minor victims and the crime of possession of child pornography. Further, there is a serious risk that the defendant will flee and that the defendant’s release will present a substantial risk to the community.

            "The crime alleged in the instant complaint involves circumstances that require the Court to consider a rebuttable presumption that no condition or combination of conditions will reasonably assure the appearance of the defendant as required and the safety of other persons and the community."

            The government's argument against releasing Lewis also raised the possibility that the two child pornography charges may not be the only crimes with which Lewis will be charged.

            "As the affidavit in support of the criminal complaint demonstrates, the nature and circumstances of the charged offense and as yet uncharged offenses, the weight of the evidence, the defendant’s history and characteristics, and the nature and seriousness of the danger to any person or the community that would be posed by the defendant’s release, each compel the conclusion that there is no condition or combination of conditions that will reasonably assure the appearance of the defendant as required and the safety of other persons and the community."
