    President Trump Sets Sights on Bump Stocks

    Finally, on the day before the March for Gun Control, the Trump administration issued a proposed rule to ban bump stocks.

    Gun Owners of America is opposed to this proposed rule and considers it yet another infringement of our Second Amendment-protected rights.

    "Shall not be infringed" means what it says -- gun control should NOT be the jurisdiction of the U.S. government.

    To be sure, banning these items will not make us any safer and it will only lead to more infringements -- to restrictions on magazines, match triggers and more.

    It’s unfortunate that the Trump administration is placing itself to the left of the Obama administration, which determined in 2010 that bump stocks did not convert a semi-automatic firearm into a fully-automatic weapon.

    After the 90-day public comment period is over, Gun Owners of America will seek out other pro-gun organizations to join us challenging this illegal executive action in court, once the rule becomes finalized.

    And we predict that an honest, constitutional and legal analysis by the courts will result in this regulation being struck down.

    Red flag laws let police confiscate guns without due process. Suspending the Constitution in a secret hearing is a Rubicon from which there is no return.

    To listen to the media's anti-gun drumbeat, no one does — or could — oppose the concept of stripping Americans of their constitutional rights in secret proceedings where they have no voice.

    But this is exactly what is at stake with Gun Confiscation Orders — cynically disguised as "red flag laws."

    Six states have enacted these laws. At their core, they allow the police to convene a Kafkaesque secret proceeding, in which an American can be stripped of his or her gun rights and Fourth Amendment rights, even though gun owners are barred from participating in the hearings or arguing their side of the dispute.

    The first thing gun owners learn is when police knock on the door — ready to ransack their house and, if they resist, to arrest or even shoot them and their family.

    The standard is not whether there is probable cause to believe that the gun owner has committed a crime, as the Constitution would seem to require. Rather, the standard is some subjective determination about whether the owner represents some "danger."

    As in the film Minority Report, Americans are stripped of their fundamental constitutional rights based on the subjective possibility of a "future crime." And we know from our limited experience that many accusers lie or make mistakes — even more reach delusional conclusions — and the target is frequently an abused victim who is most in need of the wherewithal to protect against an abuser.

    After a fixed period of time — say, 21 days — the gun owner can ask for a court hearing to restore his or her constitutional rights. But guess what? Few gun owners have the sophistication or the thousands of dollars it would take to hire a lawyer and expert witnesses. And few courts are willing to second-guess themselves and reverse the Gun Confiscation Order which has been issued.

    In fact, hundreds of thousands of veterans have lost their gun rights without due process pursuant to a comparable procedure. And recent revelations from the VA suggest that fewer than 50 have successfully invoked this "process" to get their rights back.

    But there's a larger issue: If the Constitution can be suspended in a secret hearing, where does this lead?

    What if this newspaper could be shut down for 21 days without due process — based on a secret complaint? Or an individual could be arrested or imprisoned for 21 days? Or tortured?

    Far from being a "consensus proposal," the suspension of the Constitution in a secret hearing is a constitutional Rubicon from which there is no return.

    Law-abiding gun Owner Killed During Red Flag Confiscation Raid



    Gary Willis, a resident of Ferndale, Maryland, was awakened Monday morning at 5:17 a.m. when two officers from Anne Arundel County knocked on his door. A law-abiding gun owner, Willis answered the door “with a gun in his hand,” according to a police department spokesman. They were there to serve him with an “extreme risk protective order” and remove his legally owned firearms.



    According to the spokesman, Willis put his firearm down to read the ERPO but then, apparently recognizing that it wasn’t a legal search warrant issued by a judge in accordance with protections guaranteed to him by the Fourth Amendment to the U.S. Constitution, but instead was issued by a local judge under Maryland’s newly minted “red flag” law, he retrieved his firearm.



    The spokesman said that Willis “became irate.” In the melee that followed, one of the firearms carried either by one of the officers or by Willis went off. One of the officers then pulled his own sidearm and shot Willis dead.



    Family members told Capital Gazette reporters that a distant relative had requested the ERPO the day before, due to an “incident” that occurred at his residence. The details of the “incident” remain unclear at this writing, but the backpedaling by the police chief began almost immediately.



    Said Anne Arundel County police chief Timothy Altomare:



    If you look at this morning’s outcome, it’s tough for us to say, “Well, what did we prevent?” Because we don’t know what we prevented or could’ve prevented.



    What would have happened if we didn’t go there at 5 am?



    Probably nothing. Because during his many years as a resident at his home in Ferndale nothing untoward happened. His niece, Michele Willis, said “I’m just dumfounded right now. My uncle wouldn’t hurt anybody.”



    Chief Altomare announced that since the law became effective on October 1, there have been 19 ERPOs issued in his county, his officers have served nine of them and have seized “around 33 guns” in the process. So successful have the unconstitutional raids been in Anne Arundel County that the department is building a new storage facility specifically to accommodate all the firearms they are expected to confiscate under the new law.



    Gun grabbers are delighted with the new laws springing up around the country. Jonas Oransky, deputy director of Everytown for Gun Safety, calls the unconstitutional gun-confiscation laws a “new frontier” in his group’s attack on private ownership of firearms: “We think of this is a new frontier. We don’t have a perfect system in this country, and we can’t stop every act of gun violence. [But these “red flag” laws are] a way for states to take some care and be somewhat nimble when there is a dangerous case.”



    The point of the Fourth Amendment (“The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause.”) is to protect private citizens such as Gary Willis from living in a police state where police can be “nimble” and arrive unannounced at 5:17 in the morning with a piece of paper that says they have the right to take his guns.



    The point of the “red flag” laws, however, is to do an end run around that Fourth Amendment. As The New American noted back in March when “red flag” laws started popping up in a number of states in response to the Marjory Stoneman Douglas High School shooting in Parkland, Florida: “The ‘red flag’ provisions do not allow the person charged to defend himself or even to know who his accuser might be. Further, he must prove his innocence in order to get his confiscated firearms returned to him. He is “guilty until he proves himself innocent.”



    ERPOs lower the standard in the Fourth Amendment — probable cause — to “reasonable cause.” They allow judges to act quickly (in Gary Willis’ case, overnight) before the victim gets wind of what’s coming and can secure legal counsel to defend himself or make other arrangements to protect himself and his property.



    Willis isn’t the first citizen to be caught in the “red flag” web, just the first one to die as a result. In Seattle, an agency called the “Crisis Response Squad” has already pre-identified pre-criminals before they committed atrocities and seized their legally owned firearms. On March 1, one of those identified as a “precriminal” didn’t comply with the court order and made the headlines when police entered his residence and forced him to relinquish his weapons.



    KOMONews.com covered the incident, informing its readers that the 31-year-old man hadn’t committed a crime but was guilty of “escalating behavior," whatever that means. Some workers at a local restaurant, according to KOMO News, said the defendant “harassed” them while he was carrying a holstered firearm (which is legal there).



    KOMO News added that this man’s “precrimes” included a history of police seizing a shotgun from him “in a different incident.” After entering his residence with the so-called warrant (based not on “probable cause” but on the much lower standard of “reasonable cause”), the police not only retrieved a .25-caliber handgun but then entered the residence of one of the man’s family members, where they hoped to find some other firearms belonging to him.



    A teenage girl from Pembroke Pines, Florida, was brought to police headquarters and subjected to more than two hours of questioning about her posts on social media. No attorney was present. None was needed. After all, the right to “lawyer up” isn’t allowed under the state's new law. Said Pembroke Pines Police Captain Al Xiques, his “police department will pursue those Risk Protection Orders in accordance with the new law when we determine that it is necessary in order to protect the public’s safety.”



    The girl’s attorney is suing to have the new Florida law overturned.



    And then there’s the case of Broward County, Florida, Sheriff’s bailiff Franklin Joseph Pinter, age 60, who allegedly made some verbal threats toward other bailiffs and, again allegedly, was seen on the fifth floor of the county courthouse leaning over the railing and pretending to hold a long gun and shooting at people below.



    This was all that the judge needed. On Friday, May 25, the sheriff’s office sought the ERPO, which the judge granted that same afternoon. No trial. No defense. No witnesses. No one representing Pinter. In fact, Pinter had no way of knowing about the court order to seize his 67 firearms until deputies showed up at his door.



    Where will this end? Repeal isn’t likely, as states, encouraged happily by gun grabbers, are pushing for more “red flag” laws, not fewer. Instead, it will end when a court grows a backbone and declares them unconstitutional. Until then, every citizen legally possessing a firearm in “red flag” states is in danger of having a relative, an acquaintance with whom he has had a disagreement, a disaffected or offended neighbor or co-worker, a mental health “professional,” or as is sometimes the case, the police themselves, petition a judge and obtain an ERPO that enables local police to remove the offending weapons from his possession, by force if necessary.



    Resistance, as Gary Willis found out, is not only futile, but fatal.

    Thumbs down Flimsy Lindsey Gay-Ram: The Latest Repulsivecunt To Cuck Out On The Second Amendment

    Lindsey Graham Holds (Kangaroo) Court




    In the Senate this week, Judiciary Chairman Lindsey Graham packed a panel appearing before his committee that was almost entirely supportive of all-out gun confiscation.



    Not surprisingly, Graham refused to announce his witness list until 24 hours before the hearing. And he refused to allow other Republican senators to have any input.



    Then he paraded before the American people a carnival of gun-hating fools -- complete with a sign-waving demonstrator and a bench of Democrats proclaiming that gun confiscation wasn’t nearly enough for them.



    That said, for all of his efforts, it appears to us that Graham lacks the votes right now to pass any of the “red flag” gun confiscation bills that have been introduced.



    No doubt, this is in large part to the TREMENDOUS outpouring of emails, postcards and phone calls that Senators have been receiving from GOA members.



    Reports indicate that Senators have received tens of thousands of these contacts. And part of this includes responses that have been generated from radio ads that GOA has run in key districts.



    Iowa is one of the states where GOA has mobilized considerable numbers of gun owners.



    And to his credit, former Judiciary Chairman Chuck Grassley (R-Iowa) responded well and offered the best line of questioning against red flag laws during the hearing.



    No Clear Path for Gun Grab Bill




    One of the witnesses, David Kopel of the Independence Institute, laid out at least five unconstitutional aspects of state red flag bills that would have to be addressed before they could be assured of passing judicial muster.



    So far, none of the 14 states with red flag gun confiscation programs would qualify to get federal funding under the two Senate bills which have been introduced this year (S. 7 and S. 506).



    For starters, none of these “red flag” states provide any due process protections before confiscating people’s guns.



    Moreover, since none of the 14 states are likely to change their current laws, it would appear to be metaphysically impossible to inject due process into the state-funding legislation.



    This is a surprisingly good position for us to be in, but the battle is far from over. We need to keep the heat on Senators.



    So please make sure to contact your Senators and encourage them to OPPOSE S. 7 and S. 506.

    President Trump won the White House because he actually listened to Americans like you and me.

    And right now, we need him to listen to us before he does something DRASTIC -- again.

    Following a report that the killer in the Virginia Beach shooting used a firearms suppressor,the President has been considering banning what the media calls “gun silencers.”

    We need to warn him that if he bans suppressors, not only will he be waging war on the Second Amendment, he’ll be waging war against his own political base.

    After all, because of the President’s actions, gun owners in Pennsylvania, Ohio, Iowa, Florida, and other must-win states may not show up to vote for him again in 2020.

    While the swamp is trying to get to him, we need to guarantee our voices are the only ones he hears.

    I want to be 100% clear -- it would SICKEN me to see any of the 20 radical Democrats running for president in the Oval Office.

    We need to get the President’s attention and convince him that by supporting the Second Amendment, he is not only upholding his oath of office, he’s also doing what’s in his best interests politically. But we need to convince him of this before he gives away more ground on our rights.
