On June 20, 2018, plaintiff filed a Motion for Change of Venue and, If Necessary, a Motion for Change of Judge. Missouri Supreme Court Rule 51.05 provides that a party is entitled to an automatic change of judge if the application is made within 60 days of service of process or 30 days of the designation of the trial judge, whichever is later. The assignment of the trial judge was made on April 24, 2018. This application for change of judge is outside of that time frame so petitioner is not entitled to relief on that ground. However, this case was filed on April 13, 2018. Service of process was obtained on April 18 on some defendants and April 24 on other defendants. Plaintiff is within the 60 days of service of process and therefore is entitled to a change of judge as a matter of right. Plaintiff's Motion for Change of Judge is sustained. The clerk is requested to notify the Supreme Court for designation of trial judge. Hearing date of June 29, 2018 is stricken. So ordered, Dean G. Dankelson, Circuit Judge.
