    The trial of American political prisoner Edgar Steele, charged with possession of a destructive device in relation to a crime of violence, use of interstate commerce to commission murder for hire, use of explosive material to commit a federal felony, and tampering with a victim, began in Boise, Idaho on Tuesday April 26th 2011 with jury selection. A pool of 65 potential jurors was called to the federal courthouse in Boise this morning; twelve primary jurors and two alternates would be selected. Although court was scheduled until 5 p.m. today, trial for the rest of the week is scheduled from 8:30 a.m. to 2:30 p.m. MDT. Steele faces at 30 years in prison if convicted of the most serious charge - possession of a destructive device.

    The jury selection was completed today; 14 jurors were selected, 13 women and one man. Potential jurors were quizzed on their feelings about lawyers, their experiences with the federal government and their interest in subjects ranging from explosives to popular crime television shows. Most notably, all jurors were asked if they were affiliated with groups that either advocated ?racial or ethnic superiority? or opposed it; only one said yes - a woman who said her daughter served as the youth representative for the Ada County Human Rights Commission. She was not stricken because of that. Among those excused were a forensic psychologist, a former law enforcement officer for the Department of Transportation and a woman who said she was upset over the way federal agencies have handled land use issues in the West. Interesting observation by Leonard Rouse on VNN Forum; he thinks selecting so many women for the jury could backfire against the prosecution, because if Cyndi Steele continues to stand by her man, it will put the prosecution in the position of having to risk denigrating Mrs. Steele to a bunch of other women. Oops.

    Opening statements in the trial are expected to begin on Wednesday April 27th. Cyndi Steele speculates that FBI Agent Sotka [present when Mr. Steele was arrested June 11th, 2010] and Federal informant Larry Fairfax will be among the witnesses testifying. She believes the prosecution will call her to testify as early as Thursday April 28th.

    An interesting comment about the tapes was posted to the Spokesman-Review:

    The defense hired audio experts who have revealed that the prosecution tapes were manufactured, but the Judge won?t allow their testimony. The experts have produced charts showing 351 electronic transients that occur where splices have been made. The two tapes of June 9 and June 10 contain about 30 and 40 minutes of audio, and there are all sorts of discontinuities and changes of background noise and changes of subject in these tapes, and the electronic transients that the experts found always occur at the beginning and ending of these dubs.

    If the Judge had shown fairness, he would have allowed the defense experts to display these electronic graphs to the jury, and would allow the prosecution to attempt to rebut them. But the government wants to silence Edgar Steele, and what we have is a farce, a kangaroo court. We need to put in jail those who manufactured these phony tapes.

    Day Six of the Edgar Steele trial proved to be short; on May 3rd, 2011, the jury was sent home for the day early after Judge B. Lynn Winmill disallowed a request by the defense to let audio expert George Papcun give testimony remotely from his present location in Bora Bora. Judge Winmill is also reviewing Larry Fairfax's handwritten notes to determine if Steele's defense team are entitled to the material.

    Summary: Judge Winmill ruled that audio expert George Papcun could not deliver testimony remotely from Bora Bora, where he is currently vacationing, although the judge did say there's a chance Papcun could fly to Boise overnight and testify on May 4th. Edgar Steele's defense team failed to subpoena Papcun, but had still requested a two-day extension to give them time to get Papcun to Boise. If Papcun testifies, prosecutors will present rebuttal witnesses.

    Update: According to Cyndi Steele, Papcun would have needed to be in the courtroom by 8:30 A.M. on May 4th to be allowed to testify. Flying him in commercially would have resulted in an arrival by 4:20 P.M. They examined the possibility of flying Papcun in by private jet at a cost of $120,000, but the window of opportunity quickly closed. So Papcun will not be testifying.

    On April 21st, Judge Winmill had ruled that neither of the two audio experts, George Papcun and Dennis Walsh, would be allowed to testify at the trial primarily because he questioned the sufficiency of their background and experience. However, the door to Papcun's testimony was re-opened on May 2nd by testimony from both Cyndi Steele and, in particular, Kelsey Steele; Kelsey Steele testified that on the recording of her father discussing a plot to kill her mother, she recognized her father's voice on parts of the recording but not on others; the speech patterns varied.

    The defense is contending that the audio tapes have been altered to prejudice the case against Steele; George Papcun, who holds a PhD in acoustic phonetics and whose resume shows work on the Jon Benet Ramsey trial, work on recordings for Paula Abdul and work for the Associated Press on the O.J. Simpson trial, examined the recordings and found unexplained anomalies that could have been triggered by editing, or by other factors including electronic glitches, and noted that they were of poor quality. Some have claimed there are as many as 351 different anomalies.

    Judge Winmill is also reviewing Larry Fairfax's handwritten notes to determine if defense lawyers in Edgar Steele's murder-for-hire case are entitled to the material. This became an issue when he ordered prosecutors to obtain the 238 pages of notes last week. Prosecutors had objected to Winmill's request, saying they are not evidence under federal case law. But because Winmill forced prosecutors to obtain the notes, Steele's lawyer, Robert McAllister, argued they needed to be provided to the defense. Fairfax's lawyer, John Miller, also objected to the defense request, noting that no one has been subpoenaed for the material, defense lawyer Robert McAllister said he didn't subpoena the notes before trial because he didn't know they existed until Fairfax referenced them in cross examination last week.

    Yet to be determined is if Edgar Steele himself will testify. If neither Papcun nor Steele testify, the defense could rest and the case turned over to the jury as early as May 4th. Judge Winmill's goal is to give the case to the jury by the close of business on May 5th.

    Analysis: The best-case scenario is if Fairfax's notes are made available to the defense, Papcun tesifies, and, if capable of doing so credibly, Edgar Steele himself testifies. If all three of these conditions are met, the chances of an acquittal on the three most serious charges are good.

    While Edgar Steele's health may be an issue, his testimony would be essential. If he fails to testify in his own defense after his wife, Cyndi, testified so fervently and faithfully on his behalf, there's a risk the jury might perceive him as hiding behind his wife's skirts. With 11 women on the primary jury, that could be fatal to Edgar Steele's cause. But Steele must testify coherently; he can't just get up there and start aimlessly rambling about "ZOG".

    BOISE — A North Idaho lawyer accused of plotting to blow up his wife failed to convince a federal jury Thursday that he was the victim of a government conspiracy to silence him.

    The jury 11 women and 1 man convicted Edgar Steele on all four counts against him, which alleged he’d hired a hitman-turned-FBI-informant to kill his wife, Cyndi Steele, and mother in law. Federal agents foiled the plan, though a pipe bomb later was found attached to Cyndi Steele’s sport utility vehicle and was disarmed.

    Cyndi Steele, however, stood by her husband throughout the case.

    “He’s innocent,” an emotional Cyndi Steele said after the verdict was read. “He did not do this, and we have the proof, which was denied in the courtroom.”

    The Steeles contend secret government recordings by the FBI of Edgar Steele plotting the would-be murder with the family’s handyman, Larry Fairfax, were fabricated. Prosecutors dispute it, but an audio expert that Steele had hired to question the authenticity of the recordings was unavailable to testify because he reportedly was vacationing in Bora Bora.

    Jurors began deliberating Wednesday afternoon to decide if Edgar Steele hired his handyman, Larry Fairfax, to kill his wife with a pipe bomb, or if he is the victim of a government conspiracy to silence him because of his political views and legal work.

    Steele describes himself as the “attorney for the damned” and represented the Aryan Nations in the 2000 lawsuit from the Southern Poverty Law Center that bankrupted the racist group. He has been in custody since his arrest June 11 at his home near Sagle.

    The case was moved to Boise after the trial was delayed at the last minute in Coeur d’Alene March 7.

    Cyndi Steele believes he is innocent and has criticized prosecutors for not pursing more serious charges against the alleged hitman-turned-FBI informant, Larry Fairfax.

    Fairfax was arrested June 15 after Coeur d’Alene auto shop workers found a pipe bomb under Cyndi Steele’s car. The FBI says Fairfax put it there but never told investigators. Fairfax pleaded guilty last October to two federal weapons charges and is to be sentenced after Steele’s trial.

    Prosecutors say Steele wanted his wife killed so he could pursue a relationship with a 25-year-old Ukrainian woman.

    Steele sent more than 14,000 messages to the woman and others whom he met through an online dating website. His wife and other supporters said the communication was part of his research into Russian mail order brides.

    Defense lawyer Robert McAllister questioned the authenticity of FBI recordings in which Steele discusses the murder plot with Fairfax.

    In the recordings, Steele discusses planned alibis for the day his wife is to be killed. Before his arrest, investigators told Steele his wife was dead to observe his reaction and see if he brought up the proposed alibis.

    Police described Steele’s reaction as flat and forced until they told him he was under arrest for murder for hire and a fecal odor filled the air.

    “I would submit that his body reacted and told more truth than his mouth did,” Assistant U.S. Attorney Marc Haws said in his closing argument Wednesday.

The verdict came rather quickly; jurors only began deliberating Wednesday afternoon following a week and a half of testimony. There were initial signs that a quick verdict would be rendered when jurors requested permission to deliberate into the evening hours on May 4th.

    But Cyndi Steele, who stood by her husband throughout the entire ordeal and who testified on his behalf during the trial, does not accept the verdict. ?He?s innocent,? an emotional Cyndi Steele said after the verdict was read. ?He did not do this, and we have the proof, which was denied in the courtroom.? Cyndi Steele also implied that Edgar's politics were a factor, noting that her husband believes everyone is entitled to legal representation and had agreed to represent the Aryan Nations? founder, Richard Butler, against the lawsuit. She said her husband disagreed with some of Butler?s positions but supported his right to legal representation, and has paid a heavy price over the years for that commitment.     It's true that favorable evidence was denied; the two audio experts who could show tampering with the audio tapes were initially banned from testifying, and then when Judge Winmill changed his mind about George Papcun, he imposed conditions logistically impossible for Papcun to meet. It was not a level playing field, and it is questionable whether it was ever intended to be a level playing field.

    One of Steele's defense lawyers, Robert McAllister, said he expects Steele will appeal. Another one of his attorneys, Gary Amendola, also said an appeal was imminent, complaining about pretrial rulings made by Judge Winmill that Amendola claimed prevented testimony from a critical expert witness and a full and effective defense. Of course, not even God knows how much money an appeal will cost. Steele is to be sentenced on August 22nd in Coeur d?Alene. He faces at least 30 years in prison on the most serious charge alone, possession of a destructive device in relation to a crime of violence; that time must be served consecutively to the murder-for-hire sentence, which could be up to 10 additional years. Considering that Steele is 65 years old, this is a slow-motion death sentence.

    It is absolutely astounding that this jury could return a verdict of guilty, particularly on the three most serious charges. Admittedly, there were some ambiguities in the Steele case, such as the 14,000 emails to the Ukraine, and the tapes, on which Steele apparently discussed planned alibis for the day his wife was to be killed, appeared damning, but to find him guilty, the jury had to have done the following:

    -- Ignored the fact that Edgar Steele Steele recently paid $2,779 to save his mother-in-law's home; why would he do that if he intended to kill her?

    -- Took no notice of the fact that two audio experts who could have exposed anomalies in the Steele tapes were barred from testifying (what did the prosecution have to hide?)

    -- Disregarded the obvious character deficiencies of an informant, Larry Fairfgax, who was exposed as a congenital liar in court and who sought celebrity publicity from this case, talking about writing a book and appearing on Oprah. Also disregarded the fact that Fairfax installed the bomb without telling his FBI controllers.

    -- Decided that Cyndi Steele's defense of Edgar was a manifestation of "Stockholm Syndrome" rather than a truthful recollection of the events.
    This was the verdict of a typical brainwashed Kwan jury who still holds a child-like faith in our justice system and federal government being simon-pure and inerrant. Had they been Alaskans, and aware of the prosecutorial misconduct in the cases of Ted Stevens, Vic Kohring, Pete Kott, and Bruce Weyhrauch, they would have returned a different verdict. We Alaskans have seen the seamier side of federal justice; it is much harder to fool us.

    My Boss, The Jew Lover Morris Dees, AKA the Poverty Pimp, of the so called Southern Poverty Law Center, weighs in on the trial. The organization has a net worth of nearly $150 million and is quite a scam. I have to give the Poverty Pimp credit. He actually tied the VNN forum to press on most of the issues of the trial.     As early as today, a federal jury in Idaho will begin determining the fate of Edgar Steele, a volatile attorney who represented leading racists before becoming an anti-Semitic writer, lecturer and icon of the radical right.

    During his two-week criminal trial in Boise, Idaho, federal prosecutors used witnesses to depict Steele as the mastermind behind a failed pipe bomb-murder plot aimed at his wife and her mother. He is accused of hiring Larry Fairfax, a handyman-turned-hitman-turned-FBI-informant, who actually planted a pipe bomb on Cyndi Steele’s car without telling his FBI handlers.

    The murder plot allegedly was hatched while the 65-year-old Steele used Skype from his North Idaho horse ranch for Internet trysts with a young Ukrainian woman, described as his girlfriend by investigators. In videotaped testimony from the Ukraine, the 25-year-old woman recalled conversations about lovemaking and having babies once Steele’s wife was out of the picture.

    Defense attorneys argued that all that was nothing more than Steele’s academic interest in human trafficking — a “Russian bride scam” that Steele was researching for a book — and the murder plot actually was concocted entirely by Fairfax after he stole silver from the Steele home. Cyndi Steele has backed up her husband’s version of events.

    Defense attorney Robert McAllister also attempted to convince the jury that secret FBI recordings detailing the murder-for-hire plot involving Fairfax and Steele were somehow altered by the FBI — an allegation flatly denied by the prosecution.

    But McAllister didn’t subpoena his own audio expert, George Papcun, to back up the claim the recordings were altered. Papcun was vacationing in the French Pacific island of Bora Bora and unavailable to testify in person on Tuesday, when the judge denied a defense request to delay the trial.

    In a posting on the “Free Edgar Steele” website, Cyndi Steele wrote late Tuesday that the defense team couldn’t get Papcun to Boise by commercial planes and it would have cost $120,000 for a chartered jet. “Unfortunately the window of time to make such arrangements was not long enough and the opportunity to have [our] audio expert, Dr. George Papcun, testify has been lost,’’ Cyndi Steele said in her posting.

    She didn’t explain why the defense team didn’t subpoena the audio expert, requiring his presence at the trial, before he left on vacation. But she did ask her husband’s supporters to “pray that no one else has to go through what we have been put through by our government.”

    She gave no hint as to whether or not her husband will be the last defense witness, taking the stand in his own defense. If he doesn’t, there will be closing arguments today, followed by the reading of jury instructions before jurors get the case.

    Steele’s 20-year-old daughter, Kesley Steele, and his wife, both testified for the defense in the trial that was moved to Boise from Coeur d’Alene, Idaho. Kesley Steele told the jury she recognized her father’s voice on the tape recordings, but said that wasn’t the way he talks.

    Assistant U.S. Attorney Traci Whelan asked Kelsey Steele if it was true she didn’t want to believe that her father wanted her mother killed. “Of course I don’t want to, and I don’t,” was her reply, according to the Spokesman-Review newspaper.

    For her part, Cyndi Steele testified that she doesn’t believe for a minute he intended to kill her, alleging instead that he was framed by the federal government.

    While questioning Cyndi Steele, defense attorney McAllister brought up the fact that Edgar Steele represented the neo-Nazi Aryan Nations and its late founder Richard Butler in a successful 2000 civil suit brought by the Southern Poverty Law Center. The suit, based on an attack by Aryan Nations guard on a woman and her son, resulted in a $6.3 million judgment against the group based in northern Idaho and Butler.

    Prosecutors objected to mention of the Aryan Nations, but U.S. District Court Judge B. Lynn Winmill allowed the testimony.

    Cyndi Steele testified that her husband had represented “unpopular causes,” including the Aryan Nations, and said her family has received death threats, the Spokane newspaper reported. She also testified that she was helping her husband investigate a “Russian mail-order bride scam.”

    Cyndi Steele testified that E-mails her husband sent to Russian women were “cyber-space fantasy.’’ She said her husband was an “excellent writer” capable of sounding like “a love-sick teenager.”

    Cyndi Steele made no mention of her husband’s other writings — anti-Semitic tirades and essays posted on various extremist websites in the wake of the Aryan Nations trial.     The jury, composed almost entirely of women, heard testimony that in one E-mail Edgar Steele told his Ukrainian girl friend that the Anti-Defamation League, an anti-racist Jewish organization, “manufactured the recordings of him” plotting to kill his wife. “This has been a huge shock to me but not really a surprise; they have been after me for a long time because of my outspoken criticism” of the federal government and U.S. power brokers, Steele wrote Loginova.

    FBI Special Agent Brent Smith, currently based in the Ukraine, read the E-mail to Loginova, who declined to travel to the United States, but gave prosecutors a videotaped deposition in early March.

    In the deposition, Loginova, speaking through a translator, said she met Steele through an online dating website, exchanged E-mails and learned about his personal life, the Spokane newspaper reported. Steele wrote that Loginova could “take care of our babies, make love to me, whatever would make you happy.”

    “Did he ever tell you if he had kids?” federal prosecutor Whelan asked the young Ukrainian woman. “Yes, he did,” Loginova responded through a translator. “[He] told me that they don’t live with him though. He told me that he lives alone.”

    Steele planned to travel to Ukraine to visit her in August 2010, but was arrested two months earlier. In one message, Steele promised to mail Loginova a teddy bear he named “Eddie Bear.” But she never got the gift after his arrest because his “ex-wife” never mailed it.

    Even behind bars, Steele continued to profess his love for the Ukrainian woman via letters, the jury was told. The Coeur d’Alene Press reported that in one, Steele wrote: “I miss you so much. I seem to dream about you every night. I found myself daydreaming about you being near me. It has been nearly three weeks since we last saw each other via Skype.”[/QUOTE]
