    GRANBY, Mo. — As Mayor Richard Eutsler drives through town, he points out different buildings he'd eventually like to see torn down.

    They've been falling into disrepair for a long time, he said, some of them left empty for 30 years.

    Those buildings are among more than 30 Eutsler would like to see demolished, in hopes of benefiting the town.

    “I'm hoping that we'll have a clean little town here,” he said.

    Among Eutsler's big concerns are the potential safety hazards the structures present — he's worried about someone getting into them and possibly getting hurt.

    Alderman Bill Cooper also pointed out that cleaning up the town's appearance could bring in more business.

    The city is looking into applying for a federal Community Development block grant to help with the costs of the effort, though Eutsler said officials are uncertain how long that process would take. He said he also wants to work with individuals, including owners or potential buyers, to get the properties cleaned up.

    Alderman Travis Gamble said he agreed the issue needed to be addressed — when the city is able to take on those projects.

    “It's a problem that needs to be addressed, but I don't see it being economically feasible at this time with the other issues we are facing,” he said.

    Cooper said he believed city residents also would support the cleanup, but he said he thought the effort would have to wait until the city has financial help for the work. And he said he believes the city needs more direction in determining how the process might happen.

    “It needs to happen, but its not going to happen unless we get a grant," he said.

    Cooper also he said he believes the city's first priority is improvements to the city's waste-water treatment plant.

    “This is what we need first, and then we'll worry about the dwellings,” he said.

    Eutsler said he thinks addressing the dilapidated buildings would improve safety and boost property values as well as increase "respect for our town as being a clean, neat town like it used to be."

      (Today's Newton County News hit the streets today with an investigative report from Chad Hayworth following the execution of a federal search warrant last week at the city of Granby's sewer plant. Hayworth, a graduate of Missouri Southern and a one-time Chart editor, has been on a role for the past several months, taking the role of watchdog, which some newspapers in this area have conveniently forgotten, seriously. Chad has given me Randy Turner permission to run this article in its entirety.)

      Former Granby sewer superintendent Chuck Ranslow — along with, perhaps, other city officials and employees — falsified testing data at the city's sewer plant and lied on government-mandated monitoring reports for more than 2 ½ years, federal investigators say.

      A team of criminal investigators from the Environmental Protection Agency served a search warrant Thursday at Granby's sewer plant, seizing lab results, check sheets, budget documents, city council reports, operator notes and an electronic clone of the sewer plant's computer, among other items, federal court records show.

      Investigators also stopped at Granby City Hall seeking information.

      The government's case is laid out in a 17-page affidavit by EPA Special Agent Kimberly M. Bahney, a Kansas City-based criminal investigator. The affidavit is the basis for the search warrant, which federal Magistrate Judge David P. Rush signed on Feb. 20, court records show.

      The EPA believes that Ranslow repeatedly falsified the results of tests he was required to conduct on the sewer plant's discharge by listing the same levels of total suspended solids, ammonia, and oil and grease on successive reports.

      By falsifying the lab results, Ranslow was able to hide from state and federal investigators that the plant was discharging unacceptably high levels of the three elements, the affidavit shows.

      Both the federal Clean Water Act and Title 18 of the United States Code forbid making false or fraudulent statements. Both statutes carry the possibility of fines and federal prison sentences for those convicted of violating them.

      The apparent subterfuge came to light during a four-day inspection of the plant in late September and early October by EPA inspector David Pratt, whose work is being conducted independently of the criminal investigation.

      In an interview last month with Bahney, Pratt said that he discovered the repeated element levels during his review of paperwork at the plant.

      Of 127 values reported on internal lab tests from January 2012 to September 2014, only nine were non-replicated. The reports showed a total suspended solids level of 2.3 milligrams per liter on 12 separate occasions, while 11 other levels were replicated at least five times during that time period.

      Pratt told Bahney that in his decade as an inspector, he has never seen a sewer plant obtain the exact same figures while testing at different times.

      The records — sworn to be true and correct — that showed the false data were signed by both Ranslow and Granby Mayor Richard Eutsler and submitted to the state Department of Natural Resources, the affidavit shows.

      Reached for comment Tuesday, Eutsler said that while he did sign documents that were later sent to state and federal regulators, he didn't create the data included in them.

      “I didn't have any way of knowing what it was,” he said. “This could come out OK for us. I hope it does.”

      The last falsification inspectors found occurred in July 2014, a month before Eutsler campaigned to aldermen for a $2,300-a-year raise for Ranslow, saying he'd been told Ranslow was doing a great job. The City Council approved the raise by a 3-0 vote, with Alderman Travis Gamble abstaining from voting.

      Ranslow was less than cooperative during Pratt's inspection last year, the affidavit shows.

      “I felt like I was being lied to the entire investigation,” Pratt told Bahney.

      Pratt said that when he asked questions of Ranslow and Bill Breedlove, who was working at the plant as a part-time operator, he would get different answers from each, or get a different answer from the same operator later in the inspection.

      An example, the affidavit shows, was when Pratt asked about how they collected testing samples. Breedlove explained the procedure, but then Ranslow retracted Breedlove's statement and said they took samples in a different way.

      Pratt's examination of internal lab records suggest the work was being completed in the way Breedlove described, the affidavit shows.

      During the inspection, Ranslow said to Pratt: “You must think I'm a complete dumbass.” Pratt took that to mean Ranslow was probing to see if the federal inspector recognized he had been falsifying data, the affidavit shows.

      Pratt's investigation also discovered that the plant is not properly disposing of as much sludge as should be expected for a facility of its size. Records show the plant disposed of 18.6 dry tons of sludge in 2009, 14.2 tons in 2010, one ton in 2011, and 1.8 tons in 2013. No records for 2012 could be found, the affidavit shows.

      Granby's operating permit shows the plant should produce 37.4 tons of sludge per year, the affidavit shows.

      Granby's plant has been under increasing scrutiny from state and federal regulators for a series of sludge discharges into an unnamed Shoal Creek tributary, known locally as Gum Springs Branch. The affidavit notes that the Granby plant has spilled untreated sludge into the creek on at least 11 occasions since 2001.

      Pratt noted during his inspection that sludge is being discharged into the creek because the “mixed liquor” — that is, water that contains biosolids — is not being captured accurately for treatment. State regulators didn't catch the discharges because data the plant supplied was being falsified.

      In addition to falsifying results from tests he was conducting, Pratt's investigation found that Ranslow also failed to accurately document the results of plant tests conducted by an outside laboratory on documents he submitted to regulators.

      In both June 2013 and March 2014, Granby reported ammonia values that are 99 percent lower than what the lab results show, the affidavit shows. While the lab found ammonia levels of 16 and 14.9 milligrams per liter, respectively, the city's report to inspectors shows 0.16 mg/l and 0.14 mg/l. Similar results were also discovered on the city's reporting of oil and grease levels in its discharge, the affidavit shows.

      Ranslow quit in the wake of Pratt's inspection, which found five potential major violations of the plant's operating permit. He is currently working at Joplin's sewer plant, a city spokesman confirmed Tuesday.

      Granby is still awaiting the final results of Pratt's inspection and any potential administrative penalties, including fines.

      The city has hired engineer Gene Spears to find ways to improve the plant, at the behest of state regulators. Granby has about a month to present its plan for fixing the plant to the state.

      Granby aldermen met in closed session Tuesday to discuss the case. They apparently reviewed copies of the affidavit, which the Newton County News provided to them. Aldermen made no public statement when they emerged after an hour behind closed doors.

      Bahney's affidavit is not an indictment, nor does it show all the evidence the government has collected in the case.

That information will then be sent to the U.S. Attorney General's Office and they will decide what action, if any, will be taken.               She was born May 17, 1940 in Granby, Missouri, the daughter of the late Shelby and Freda (Nunn) Fitzgerald. Over a period of 40 years she served her hometown as mayor, city collector, city clerk, alderman, city manager and was the “2013 Honored Citizen”. Donna had owned and operated several businesses, the latest being the Granby Flea Market. She and partner, Ron Vandergriff, had the market for the past 20 years. Of the many things she loved: family; friends; fishing; flowers and plants; bird feeding and watching; and drives in the country, she loved her hometown the most. “Old Mining Town Days” was her favorite time.

              Throughout her adult life she worked tirelessly to promote the advancement of her favorite place, Granby, Missouri. Donna cared about her town, it’s future and it’s past. She is survived by one son, Gerald “Jr.” Fullerton of Granby; one brother, Max Fitzgerald and wife, Kathy of Bethel Heigthts, Arkansas; one sister, Lana Deadmond of Branson; one sister-in-law, Marti Fitzgerald of Branson; one aunt, Sybil Grillo of Port Washington, New York; one uncle, Herbert Nunn of Houston, Texas; three nephews; two great nephews and longtime companion, partner and friend, Ron Vandergriff. Donna is preceded in death by one brother, Robert Fitzgerald. It was Donna’s wish that there be no services. Contributions in memory of Donna may be made to the Granby

                A former wastewater treatment plant operator for the city of Granby, Mo., was indicted by a federal grand jury today for submitting false reports in violation of the Clean Water Act.

                Charles Loren Ranslow, 48, of Neosho, Mo., was charged in a three-count indictment returned by a federal grand jury in Springfield, Mo. Ranslow was the wastewater treatment plant operator for the city of Granby.

                Today’s indictment alleges that Ranslow submitted false information in state reports that are required under the Clean Water Act.

                According to the indictment, Ranslow conducted wastewater sampling at the facility and submitted Wastewater Discharge Monitoring Reports to the Missouri Department of Natural Resources from June 2013 through March 2014. The indictment charges Ranslow with two counts of making false and fraudulent statements in those reports. Ranslow allegedly submitted monitoring reports that contained false data, for example, with regard to the levels of ammonia.

                The indictment also charges Ranslow with one count of making false and fraudulent statements in a Domestic Sludge Report that was submitted to the Missouri Department of Natural Resources. Ranslow allegedly represented sludge monitoring results to be indicative of the Granby Wastewater Treatment Facility sludge, which data he knew to be false.

                Dickinson cautioned that the charges contained in this indictment are simply accusations, and not evidence of guilt. Evidence supporting the charges must be presented to a federal trial jury, whose duty is to determine guilt or innocence.

                This case is being prosecuted by Assistant U.S. Attorney Abram McGull, II. It was investigated by the Environmental Protection Agency, Criminal Investigation Division and the Missouri Department of Natural Resources.

                  Like the reporter for this newspaper, I too attended the Granby City Council Meeting of June 23, 2015. Since I was threatened again with ejection for pointing out their present and past practices in selective enforcement of their sundry ordinances, my recollection is different. But don’t count on finding the truth reading the official minutes, as they are invariably perjurous.

                  A young couple with seven children wanted to move their 2007 mobile home onto a lot in Granby. Their realtor wanted a change, as quite a few other young families can only afford older mobile homes. Mayor Travis Gamble took the position that a new mobile-home ordinance had been passed last year and thus his legistreason was somehow sacred.

                  I pointed out that the Granby mobile home ordinances were more a matter of connection to city hall. For example, in April 2005, I was arrested and jailed for a night when I protested a connected relative of the city clerk getting to move her new trailer home right next door because she tore down my old chicken-house which was on the property line. Travis Gamble, incensed at my imputation of hypocrisy, threatened me with ejection. But he does have 20 IQ points on his predecessor, who did the same in March.

                  Anyways, the City Council put it up for a vote to amend the ordinance to 10 years for mobile homes. The vote was 2-2 with Meyer Gamble voting to keep the sacred ordinance that is obeyed sometimes when convenient.

                  While I was out urging the young couple to sue the City of Granby and everyone connected with violating their rights to do with their property as they seen fit and offered to help, Barry Flint snuck his three drooling morons onto His Police Board. But that will be revisited soon enough.

                  Then the twenty landlords complained that they would be stuck with deadbeat renters’ city utility bills. Since I agree for once with Gamble that since they are running water, sewer, gas and trash that it has to be paid for by those who use the services, I said little but did gloat as Gamble’s second term stomped out the door, although I did needle Gamble by suggesting that the young couple with seven kids and the old mobile home looked the sort who paid their utility bills. Gamble got huffy at me again.

                  [Sometimes I think it is such a pity that I’m such a doctrinaire racist. If I moved 100 Somalians getting Section 8 into my broke-back hovels I could cure this silliness right quick. (Strike if necessary)]

                  Don’t let anyone tell you that this City Council is different than those of the past quarter-century. They want to be in City Hall because they want to be in City Hall. They should be gelded of any powers other than those attendant in running core city functions and stripped of any legislative powers to make ordinances they selectively enforce.

                    Granby has always had the reputation of being a foul nest of corrupt inbreds who make up city ordinances against outsiders but mainly their own to be enforced selectively.

                    Twenty-five years ago, these corrupt elements did away with the elected city marshal position to enable creating a city police force for the selective enforcement of these ordinances / bills of attainder. Barry Flint claimed that the purpose of creating a police board was for the oversight of the city police forces. Barry Flint has been head of this board ever since. With the connivance of the police board I've been falsely arrested and beaten while handcuffed several times over the years.

                    Recently there were three vacancies on the police board. I applied for one of the vacancies, promising full disclosure of all police matters if appointed. Barry Flint, with the connivance of the City Council, found three other candidates to fill these vacancies.

                    I made arrangements to be on the agenda to discuss this matter, but the current Mayor decided to remove me from the agenda. He thinks that whether a resident of Granby has a "legitimate" grievance which needs to be publicly addressed is up for him to decide. This smarmy contempt for private property and free speech rights isn’t just against myself but against you all who have to live here.

                    Yet let me state for the record that I totally agree. Those who are in power are not bound by mythical rule of law. The Law is whatever those in power say it is. Revolution and Civil War become inevitable. Just don't scream too loud when me and my kind are in power and you are adjudged to be "counter-revolutionary parasites" of the kind that Joseph Stalin adjudged unable to liquidate themselves.

                      At the Granby City Council Meeting on August 25, 2015, the Granby City Council voted by 4-0 that it got to decide how property owners kept up their property and fines them by imposing a property tax lien without “due process of law” by having a Granby police officer make a complaint, then holding a “hearing” by the Granby Chief of Police, leading to a “tax lien” upon private real property within the city limits of Granby.

                      The previous ordinances which provided for even cash-register municipal court “process” have been abolished. These new ordinances make the police “prosecutor, judge, jury and executioner” with no due process of law. These ordinances are patently unconstitutional and treasonous.

                      The Granby Police Chief told me that he hadn’t read the new proposed ordinances, but thought that they now criminalized property not in compliance with the selective will of the City Council.

                      I made the accusation that they are trying to turn Bedford Falls, er, Granby, into Pottersville, er, Flintville. The Mayor and the Council-Critters resembled them remarks.

                      It is quite clear to me that the City of Granby needs to be stripped of any ordinance-making power and its sole powers reduced to running the water, sewer, gas and sanitation services. There might be a small professional police force to keep criminal activity to an acceptable minimum, but there will be no more power to create -- or enforce -- municipal ordinances.

                      This can be accomplished by federal civil rights litigation and bringing a civil RICO action and putting those who cannot obey state and federal law into prison and fined so that their misconduct is unprofitable. The RICO action will also put an injunction against implementing the recent ordinances.

                        The East Newton Fire Protection District and the Granby City Council are closing in on an agreement to extend the contract between the two entities, aldermen learned last night.

                        Granby aldermen got their first look this week at the proposed contract, which calls for the district to pay the city $1,050 monthly, a $300 increase over the current contract, to provide fire service in the rural area covered by the district. . . .

                        And here I was thinking that it was about how much rent to charge for keeping the pumper truck, worth $100,000 plus, owned by the rural fire district, in the Granby firehouse. After all, where else is a pumper truck dependent upon city water, going to be parked, other than in the city which provides the water for the truck to use in fighting fires?
